Terms & Conditions – SummerGear International

1. Definitions

  • SummerGear International: The registered business located at Bonnet 3, 1319 EK Almere, The Netherlands, Chamber of Commerce number 96685956.
  • Customer: Any natural or legal person placing an order with SummerGear.
  • Product: All items offered by SummerGear through www.summergear.nl or affiliated online platforms

2. Applicability

  • These terms apply to every offer from SummerGear and to all agreements concluded with a customer.
  • By placing an order, you agree to these terms and conditions.

3. Product Information

  • We aim to describe and display all products as accurately as possible.
  • Minor variations in color or size may occur due to screen settings or the use of natural materials.
  • Obvious errors in pricing or descriptions do not bind us.

4. Agreement Formation

  • An agreement is established once you receive an order confirmation from us by email.

5. Prices & Payment

  • All prices are shown in euros, including VAT and excluding shipping fees (unless otherwise stated).
  • Payment must be made in advance using the available payment methods on our website.

6. Delivery

  • We aim to dispatch your order within the stated delivery period.
  • If we are unable to meet this timeframe, we will inform you promptly.
  • SummerGear is not responsible for delays caused by third-party carriers.
7. Returns & Right of Withdrawal
  • You have the right to return your order within 30 days of receipt, without giving a reason.
  • Returned items must be unused, undamaged, and in their original packaging.
  • Return shipping costs are at your expense, unless otherwise stated.

8. Warranty & Complaints

  • Our products meet normal expectations and match the descriptions provided.
  • If something is wrong, please notify us within 14 days of receipt at klantenservice@summergear.nl. We'll work with you to resolve it fairly

9. Liability

  • SummerGear is only liable for direct damages proven to result from our failure to fulfill the agreement.
  • "Direct damage" includes:
    a. reasonable costs to determine the cause and extent of the damage
    b. reasonable costs for repair or replacement
    c. reasonable costs to prevent further damage
  • We are not liable for indirect damage, including loss of profit, revenue, or any consequential damages.
  • Liability is always limited to the amount paid by the customer for the product concerned.
  • This limitation does not apply in cases of intentional misconduct or gross negligence on our part.

10. Privacy

  • We treat your personal data with care and in compliance with the General Data Protection Regulation (GDPR).

11. Changes to These Terms

  • We reserve the right to amend these terms and conditions.
  • The latest version is always available on www.summergear.com and applies from the moment of publication

12. Applicable Law & Disputes

  • All agreements are governed exclusively by Dutch law.
  • In case of a dispute, we aim to resolve it in good faith. If that’s not possible, the dispute will be submitted to the competent court in the Netherlands.
